Welcome to Acrely. These Terms and Conditions ("Terms") govern your access to and use of the Acrely website, mobile applications (which will be available to download at launch), and related services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
Joining the Acrely waitlist
Acrely has not launched yet. These Terms apply to your use of this website and the Acrely waitlist. Joining the waitlist does not create an Acrely account, guarantee access at launch, or commit you to anything. By joining, you confirm that the information you provide is accurate.
Founding member benefits shown on the waitlist page, such as the first-year membership discount, extended listing boost for landowners and the founding member badge, are offered to early members and will be confirmed in the terms that apply when the platform launches.
The rest of these Terms describe how the full platform will work once it launches, including accounts, bookings, payments and listings. Those features are not available yet. To leave the waitlist, contact privacy@acrely.ca. See our Privacy Policy for how we handle waitlist information.

(a) Landowners are solely responsible for the accuracy of Listings, compliance with laws, and the condition and safety of their property.
(b) Guests are solely responsible for their conduct, compliance with Landowner rules, and possession of required licences, permits, and insurance.
3.4 Third-Party Services
Payment processing, mapping data, Crown land overlays, identity verification, and Insurance Products may be provided by third parties. Your use of those services may be subject to additional terms.

5.3 Recreation and Lease Listings
Recreation listings and long-term lease listings may be subject to different fee structures and policies as displayed on the Platform at the time of publication.

Acrely may remove or suspend any Listing that violates these Terms, receives complaints, or poses safety or legal concerns, without prior notice.
Bookings
6.1 Booking Process
When you submit an inquiry or complete a booking through the Platform, you make an offer to enter into an agreement directly with the other User. Acrely facilitates communication and payment but is not a party to that agreement.
6.2 Guest Obligations
(a) Guests must follow all Landowner rules, activity restrictions, and access instructions.
(b) Guests must hold valid licences and permits required for the activity (e.g., Outdoors Card, PAL, fishing licence, ATV registration).

(a) Landowners must honor confirmed Bookings made through the Platform unless cancellation terms apply.
(b) Landowners must disclose known hazards, boundaries, and off-limit areas.
6.4 Off-Platform Arrangements
Bookings and inquiries must be made through Acrely. Arranging access, payment, or insurance outside the Platform voids platform protections, verification, and Insurance Product coverage described in Section 10.
Assumption of Risk
7.1 Inherent Risks
Use of private land for hunting, fishing, camping, off-roading, agriculture, storage, and other outdoor activities involves inherent and significant risks, including injury, death, property damage, wildlife encounters, weather events, terrain hazards, and equipment failure.
YOU EXPRESSLY ACKNOWLEDGE AND ASSUME ALL RISKS ASSOCIATED WITH ACCESSING PRIVATE LAND AND PARTICIPATING IN OUTDOOR AND AGRICULTURAL ACTIVITIES, WHETHER CAUSED BY NEGLIGENCE OF USERS, LANDOWNERS, THIRD PARTIES, OR OTHERWISE. YOU VOLUNTARILY ACCEPT FULL RESPONSIBILITY FOR ANY INJURY, LOSS, OR DAMAGE ARISING FROM YOUR USE OF THE PLATFORM, ANY LISTING, OR ANY BOOKING.
7.2 No Safety Guarantee
Acrely does not inspect properties, supervise activities, or guarantee that any Listing is safe or suitable for your intended use.
No Warranty

THE PLATFORM AND ALL CONTENT, LISTINGS, MAP DATA, CROWN LAND OVERLAYS, AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY. ACRELY DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
8.2 Third-Party Data
Crown land boundaries, public land maps, and other geospatial data are provided for informational purposes only. You must independently verify land status, access rights, and regulations with official sources.
Limitation of Liability
9.1 Exclusion of Damages
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ACRELY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, ANY LISTING, BOOKING, OR INTERACTION WITH OTHER USERS, EVEN IF ACRELY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9.2 Cap on Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACRELY'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE FEES PAID BY YOU TO ACRELY IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED CANADIAN DOLLARS (CA$100).
9.3 Jurisdictional Limits
Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, our liability is limited to the fullest extent permitted by law.

(a) Insurance Products are valid only for bookings and listings confirmed through Acrely.
(b) Off-platform arrangements, unverified guests, or direct landowner agreements are excluded from coverage.

Fees
11.1 Service Fees
Guests pay Acrely a service fee on recreational bookings, currently 14% of the booking subtotal (before any insurance add-ons), which is shown and added to the Guest's total at checkout. Landowners are not charged a fee on recreational bookings and receive their full listed price. Landowners listing agricultural or storage land for lease pay a one-time CA$50 listing fee instead, plus any optional boost fees displayed in the landowner dashboard.
11.2 Payment Processing
Payments are processed by third-party payment providers. You authorize Acrely and its payment partners to charge applicable fees to your selected payment method.
11.3 Taxes
Fees may be subject to applicable sales, harmonized, or other taxes. You are responsible for any taxes associated with your use of the Platform except where Acrely is required by law to collect and remit.
11.4 Fee Changes
We may modify fees with notice on the Platform. Continued use after fee changes constitutes acceptance.
